We process your data exclusively on the basis of statutory provisions (DSGVO, BDSG, TDDDG). This statement provides information about the type, scope and purpose of processing.

3. Hosting / Shop Platform (Shopify)

This website is operated on the Shopify platform (Shopify International Limited, Ireland), which processes order, customer and usage data on our behalf (processor, Art. 28 DSGVO).

4. Server Log Files

When the site is accessed, information (browser type, operating system, referrer URL, time, IP address) is stored automatically. Legal basis: Art. 6 Abs. 1 lit. f DSGVO.

5. Cookies & Consent

Cookies that are not strictly necessary (e.g. analytics/marketing) are set only after your express consent (Art. 6 Abs. 1 lit. a DSGVO, § 25 TDDDG). You manage consent through the consent banner and may withdraw it at any time.

6. Recipients / Services Used

Where you consent or where required for contract performance, data is transferred to the following recipients:

• Shopify – shop operation, order processing, reach measurement.
• PayPal – payment processing.
• Google – reach measurement/marketing (only after consent).
• AdRoll/NextRoll – marketing/retargeting (only after consent).

A transfer to third countries takes place only on the basis of appropriate safeguards (e.g. EU standard contractual clauses).

7. Orders & Payment

For contract processing, we process master and order data. Legal basis: Art. 6 Abs. 1 lit. b DSGVO; for retention additionally Art. 6 Abs. 1 lit. c DSGVO.

8. Storage Period

We store data only for as long as required or for as long as statutory retention periods (usually 6–10 years) apply.

9. Your Rights

You have the right of access, rectification, erasure, restriction, data portability and objection (Art. 15–21 DSGVO), as well as the right to lodge a complaint with a supervisory authority.

11. Liability for Data Use by Users

The user is responsible for the lawful use of data and files obtained through the shop. We accept no liability for damage or legal consequences arising from improper, abusive or unlawful use by the user.

General Terms and Conditions (AGB)

for the online shop eco-ecu.de (operator: ECO Elektrotechnik)

§ 1 Scope

(1) These General Terms and Conditions apply to all contracts between ECO Elektrotechnik, operator of the online shop eco-ecu.de (hereinafter “Provider"), and its customers concerning goods and digital content offered in the online shop.

(2) Deviating customer terms are not recognized unless their validity is expressly agreed to in writing.

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.

(2) By clicking the “Buy now" button or a comparable order button, the customer submits a binding offer to conclude a purchase contract.

(3) The contract is concluded when the Provider accepts the order.

§ 3 Subject Matter of the Contract

(1) The subject matter of the contract may be digital content, software files, ECU files, configuration files, data versions, downloads and other digital products.

(2) Unless expressly stated otherwise, no physical control unit, spare part or other hardware is supplied.

(3) The product descriptions contain the relevant information about the respective scope of services.

§ 4 Delivery of Digital Content

(1) Digital content is provided immediately after successful receipt of payment automatically by download and additionally by e-mail to the e-mail address provided by the customer.

(2) The customer is obliged to provide a correct and reachable e-mail address.

(3) The Provider is not liable for delays or non-delivery caused by incorrect customer data.

§ 5 Expert Use

(1) The products offered are intended exclusively for knowledgeable users, workshops, developers and persons with corresponding technical knowledge.

(2) The customer is responsible for checking the suitability, compatibility and usability of the purchased files for their use case.

(3) The Provider assumes no responsibility for incorrect application, programming, installation or use by the customer or third parties.

§ 6 Restrictions on Use

(1) All files provided are used exclusively at the customer's own responsibility.

(2) Where use may affect emission values, performance data, safety functions, approval requirements or other vehicle-relevant characteristics, they are intended exclusively for dynamometer, development, testing, motorsport, export or other applications outside public road traffic, unless use in public road traffic is expressly permitted by law.

(3) The customer is responsible for complying with all national and international laws, regulations and approval requirements.

§ 7 Prices and Payment Terms

(1) The prices stated at the time of ordering apply.

(2) The available payment methods are shown in the online shop.

(3) Digital content is generally provided only after successful receipt of payment.

§ 8 Right of Withdrawal for Digital Content

(1) The customer expressly agrees that the Provider begins performance of the contract before expiry of the statutory withdrawal period.

(2) The customer confirms awareness that the right of withdrawal expires upon complete provision of the digital content in accordance with statutory provisions.

(3) After digital content has been provided, return, cancellation or refund is excluded to the extent permitted by law.

§ 9 Warranty

(1) Statutory warranty rights apply.

(2) In particular, there is no defect if problems are attributable to incorrect installation, incorrect use, incompatible hardware, changes by third parties or improper use.

§ 10 Liability

(1) Claims for damages against the Provider are excluded unless otherwise provided below.

(2) The Provider has unlimited liability for intent and gross negligence and for damage arising from injury to life, body or health.

(3) In the event of slightly negligent breach of material contractual obligations, liability is limited to the typical, foreseeable contractual damage.

(4) Any further liability is excluded to the extent permitted by law.

§ 11 Copyrights and Rights of Use

(1) All files, software content, data versions and other digital products provided are protected by copyright.

(2) Transfer, reproduction, publication, rental, sublicensing or commercial resale without the Provider's express written consent is prohibited.

§ 12 Data Protection

Personal data is processed in accordance with the Provider's privacy policy.

§ 13 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If individual provisions of these AGB are or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.

(3) Statutory consumer rights remain unaffected by these AGB.

Use and Liability Agreement

By purchasing, the customer confirms:

• The purchased files are intended exclusively for knowledgeable users.
• Use is exclusively at the customer's own responsibility.
• The customer has the necessary knowledge to use the files.
• The customer independently checks the legal permissibility of use in their country.
• The Provider assumes no responsibility for damage caused by incorrect installation, incorrect application, improper use or changes to the vehicle.
• The customer is solely responsible for complying with all statutory provisions.
• The customer has been informed that certain applications may be intended exclusively for motorsport, testing, development or export purposes.

Withdrawal Instructions

Consumers generally have a statutory right of withdrawal.

For contracts for the supply of digital content that is not supplied on a tangible medium, the right of withdrawal expires, however, if the trader has begun performance of the contract after the consumer:

1. has expressly agreed that performance of the contract begins before expiry of the withdrawal period, and
2. has confirmed awareness that, by giving consent, the right of withdrawal is lost when performance of the contract begins.

Because the digital content offered by ECO Elektrotechnik is provided immediately after successful payment, the right of withdrawal expires upon provision of the digital content in accordance with statutory provisions.
